1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and TweetVid ("we", "us", or "our") regarding your access to and use of the TweetVid service at tweetvid.in (the "Service").

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Service.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through a prominent notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Eligibility

By using the Service, you represent and warrant that you:

• Are at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Are not barred from using the Service under applicable law
• Are not a resident of any country subject to trade sanctions or restrictions

If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

3. Account Registration

• Maintain and promptly update your account information

3.2 One Account Per User

You may maintain only one account at a time. Multiple accounts, account sharing, or transferring accounts to others is strictly prohibited and may result in immediate termination.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3.4 Account Termination

You may delete your account at any time through your account settings or by contacting us. Upon deletion:

• Your generated videos will be deleted within a reasonable timeframe
• Your personal data will be removed, except as required by law
• We may retain certain information for legal, tax, or fraud prevention purposes

4. Description of Service

TweetVid is a platform that enables users to:

• Convert text content (including tweets) into short-form videos
• Generate AI-powered voice narration for videos
• Customize videos with templates, colors, and branding
• Store videos temporarily on our servers
• Download and share generated videos

Note: Auto-posting to social media platforms is not currently available but may be added in the future.

5. User Content and Ownership

5.1 Your Content

You retain all ownership rights to content you submit to the Service, including:

• Tweet text and other text content you provide
• Videos generated using your content
• Images, logos, or branding you upload

5.2 Your Responsibilities

You are solely responsible for:

• Ensuring you have the right to use all content you submit
• Obtaining necessary permissions for third-party content (including tweets from other users)
• Complying with Twitter/X's Terms of Service when using tweet content
• Ensuring your content does not violate these Terms or applicable law

5.3 License to TweetVid

By submitting content to the Service, you grant TweetVid a limited, non-exclusive, royalty-free license to:

• Store, process, and generate videos from your content
• Display your content as necessary to provide the Service
• Use anonymized, aggregated data for analytics and improvement

This license is solely for the purpose of providing and improving the Service.

5.4 Marketing Usage

By using the Service, you grant TweetVid a non-exclusive license to use your generated videos for marketing, promotional, or demonstration purposes. We will only use content that you have made publicly available or explicitly submitted for this purpose. You may request removal of your content from our marketing materials at any time by contacting us.

6. Acceptable Use

You agree NOT to use the Service to:

6.1 Prohibited Content

• Generate misleading, deceptive, or fraudulent content
• Impersonate any person, entity, or organization
• Harass, bully, threaten, or intimidate others
• Create adult, NSFW, or sexually explicit content
• Promote hate speech, discrimination, or violence
• Share confidential or proprietary information without authorization

6.2 Prohibited Conduct

• Spam or mass-generate content in an automated manner
• Reverse engineer, decompile, or disassemble the Service
• Share, sell, or transfer your account credentials
• Use the Service for any illegal activity
• Abuse system limits or attempt to bypass restrictions
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service

6.3 Enforcement

We reserve the right to:

• Review and remove any content at our sole discretion
• Suspend or terminate accounts that violate these Terms
• Report illegal activity to law enforcement
• Take legal action against violators

7. Intellectual Property

7.1 TweetVid Property

The Service, including its design, features, code, branding, and content, is owned by TweetVid and protected by intellectual property laws. "TweetVid" and related marks are trademarks of TweetVid.

7.2 Third-Party Property

All third-party trademarks, logos, and brands are the property of their respective owners. Your use of the Service does not grant you any rights to use these marks.

7.3 DMCA Policy

If you believe your copyrighted work has been used in violation of your rights, please contact us at inbox.sarwang@gmail.com with:

• Identification of the copyrighted work
• Location of the allegedly infringing content
• Your contact information
• Statement of good faith belief in the infringement
• Statement under penalty of perjury of accuracy
• Your physical or electronic signature

8. Payment Terms

8.1 Subscription Plans

The Service offers paid subscription plans with different features and usage limits. All prices are in USD unless otherwise stated.

8.2 Billing

• Billing Cycle: Monthly recurring billing
• Payment Method: Processed securely by Paddle.com
• Price Changes: We may change prices at any time with notice. Changes apply to the next billing cycle.
• Taxes: You are responsible for all applicable taxes

8.3 Refunds

All purchases are final. We do not provide refunds except in limited circumstances as outlined in our Refund Policy.

Note: All plans include commercial usage rights. You may use generated videos for client work, advertisements, and monetized content regardless of your plan tier.

8.4 Cancellation

You may cancel your subscription at any time through your account settings. After cancellation:

• You retain access until the end of your billing period
• No further charges will be made
• No prorated refunds for unused time

8.5 Payment Failure

9. Third-Party Services

The Service integrates with third-party services. Your use of these services is subject to their respective terms:

• ElevenLabs: AI voice generation (subject to ElevenLabs Terms)
• Paddle: Payment processing (subject to Paddle Terms)
• Supabase: Authentication and database (subject to Supabase Terms)
• Redis: Queue management (subject to Redis Terms)

By using the Service, you agree to comply with all applicable third-party terms.

10. Service Disclaimers

10.1 "As Is" Basis

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability

10.2 No Guarantees

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service will meet your requirements
• Generated videos will be of specific quality
• You will achieve any specific results, including views, engagement, followers, or revenue from content created using the Service

We reserve the right to suspend, limit, or restrict your access to the Service at our sole discretion, including in cases of:

• Abuse or excessive usage beyond normal limits
• System strain or technical necessity

12. Limitation of Liability

To the maximum extent permitted by law:

12.1 Exclusion of Damages

TweetVid shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Errors, omissions, or interruptions
• Unauthorized access or data breaches

12.2 Liability Cap

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to TweetVid in the 12 months preceding the claim.

12.3 Essential Basis

These limitations are an essential basis of our bargain and apply regardless of the legal theory (contract, tort, or otherwise).

13. Indemnification

You agree to indemnify, defend, and hold harmless TweetVid and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of third-party rights
• Your content or conduct

14. Termination

14.1 By You

You may terminate your account at any time through your account settings or by contacting us.

14.2 By Us

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for:

• Violation of these Terms
• Conduct harmful to other users or the Service
• Illegal or fraudulent activity
• Any other reason we deem appropriate

14.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your content may be deleted
• These Terms survive (including liability limitations)

15. Dispute Resolution

15.1 Informal Resolution

Before pursuing formal legal action, you agree to contact us at inbox.sarwang@gmail.com and attempt to resolve the dispute informally. We will respond within 30 days.

15.2 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

15.3 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

15.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

15.5 Jury Trial Waiver

You and TweetVid waive any right to a jury trial in any legal proceeding arising from these Terms or your use of the Service.

16. Miscellaneous

16.1 Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or technical failures.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver. Waivers must be in writing and signed by us.

16.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.

16.5 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TweetVid regarding the Service.
